Digital Omnibus: EU Postpones Key AI Act Deadlines.

Through the Digital Omnibus package, the EU is adjusting the key deadlines of the AI Act. The stringent requirements for high-risk AI will take effect later, but one deadline is actually moving up. The Council and the European Parliament reached a provisional agreement on May 7, 2026. Please note: it has not yet been formally adopted and is therefore not yet law. A postponement is not a cancellation.

What's changing.

The agreement affects three dates. Two are pushed back, and one is moved forward:

High-risk AI, stand-alone systems (Annex III): from August 2, 2026, to December 2, 2027.
High-risk AI, embedded in regulated products (Annex I): to August 2, 2028.
Labeling requirement for generative AI (Article 50, paragraph 2): to December 2, 2026, shorter than originally planned. Synthetic output—i.e., text, images, audio, and video—must then be machine-readably labeled as AI-generated.

What this means when you're building software with AI features.

The reprieve for high-risk AI provides some breathing room. Those who build systems for recruitment or credit assessment, for example, have more time to get their compliance requirements in order. But the clock has been reset, not stopped. Preparations should already be underway, because the end of 2027 is closer than it seems.

If you’re building generative AI features, your next key deadline isn’t 2027, but December 2, 2026. Starting then, AI-generated output must be clearly labeled. That’s a design choice you can start incorporating now. To put it simply: no reason to panic, but it is a reason to put it on the roadmap. This is not legal advice.
